  • The applicant for the protection of a state is called asylum seekers. It is a human right to seek asylum, but it is not a human right to get asylum. It is up to each country to determine the grounds upon which a person is entitled to receive asylum.

 

  • According to the principle of non-refoulement No one may be deported to a country where he or she runs imminent risk to be persecuted or killed.

 

  • Within the EU we have an unified asylum policy. The unified asylum policy includes the Dublin Regulation, which means that asylum seekers can only claim asylum in one of the EU Member States. Asylum is sought in the Member State where the asylum seeker first arrived. The key is the "arrived", not where the asylum seeker first seeked asylum. It means that for example Sweden could send asylum seekers back to an other EU Member State, where the asylum seeker have evidently been, for example Denmark. If the sylum seeker came to Sweden via Denmark.

 

  • The Qualification Directive establishes uniform conditions for those who has the right to asylum.

The Directive provides in addition to refugees so-called subsidiary protection to the right to asylum, to those who could face real risk of suffering serious harm if they were returned to their homeland.

 

  • The European Court (of Human Rights) has ruled on which of the EU countries, it is inappropriate to send asylum seekers.

 

  • The Swedish Parliamentary Justice Committee recommended December 15th, 2015, an introduction of ID checks. This means that people without identity documents who are controlled by Swedish police are not allowed seek asylum in Sweden.

 

In a democratic society governed by law, it is important that the current constitution is followed. It means both the right to asylum, but also that one does not get asylum, unless factual conditions for it are fulfilled.
